(AP) ? Word of a settlement agreement between former International Monetary Fund chief Dominique Strauss-Kahn and a hotel maid who accused him of trying to rape her could bring an end to a saga that has tarnished Strauss-Kahn's reputation, ended his hopes for the French presidency and renewed a debate about the credibility of sexual assault accusers.

But it might not mean the end of legal troubles for Strauss-Kahn. He is awaiting a ruling on whether he is linked to "pimping" in connection with a French prostitution ring.

A person familiar with the New York case said Thursday that lawyers for Strauss-Kahn and the housekeeper, Nafissatou Diallo, made the as-yet-unsigned agreement within recent days, with Bronx Supreme Court Justice Douglas McKeon facilitating that and a separate agreement to end another lawsuit Diallo filed against the New York Post. A court date is expected next week, though the day wasn't set, the person said.

The person spoke to The Associated Press on the condition of anonymity to discuss the private agreement.

Details of the deal, which comes after prosecutors dropped related criminal charges last year, weren't immediately known and likely will be veiled by a confidentiality agreement. That could prevent Strauss-Kahn and Diallo from speaking publicly about a May 2011 encounter that she called a brutally sudden attack and he termed a consensual "moral failing."

Strauss-Kahn lawyer William W. Taylor III declined to comment. Lawyers for the housekeeper didn't immediately respond to phone and email messages.

Diallo, 33, and Strauss-Kahn, 63, crossed paths when she arrived to clean his luxury Manhattan hotel suite. She told police he chased her down, tried to yank down her pantyhose and forced her to perform oral sex.

The allegation seemed to let loose a spiral of accusations about the sexual conduct of Strauss-Kahn, a married diplomat and economist who had long been dubbed the "great seducer."

With DNA evidence showing a sexual encounter and Diallo providing a gripping description of an attack, the Manhattan district attorney's office initially said it had a strong and compelling case. But within six weeks, prosecutors' confidence began to ebb as they said Diallo had lied about her past ? including a false account of a previous rape ? and her actions after leaving Strauss-Kahn's room.

Diallo, who's from Guinea, said she told the truth about their encounter. But the district attorney's office dropped the charges in August 2011, saying prosecutors could no longer ask a jury to believe her.

Diallo had sued Strauss-Kahn in the meantime, with her lawyers saying she would get her day in a different court. Strauss-Kahn called the lawsuit defamatory and countersued her for $1 million.

Strauss-Kahn's whereabouts Friday were unclear. After his return to France in September 2011, Strauss-Kahn initially kept a very low profile. But in recent months, he has shown signs he is trying to rebuild his professional reputation, giving speeches at international conferences and reportedly setting up a consulting company in Paris.

Unconfirmed reports surfaced Wednesday that Diallo was in Paris this week on the invitation of a feminist group. A French lawyer who works with her U.S. defense team, Thierry de Montbrial, told The Associated Press that the reports were untrue. He declined any comment on the settlement.

Diallo's lawsuit against The Post concerned a series of articles that called her a prostitute and said she sold sex at a hotel where the Manhattan DA's office had housed her during the criminal case. The News Corp. newspaper has said it stands by its reporting; a spokeswoman declined to comment Thursday.

In helping resolve the cases, McKeon averted what could have been an ugly court drama.

Strauss-Kahn initially said he had diplomatic immunity, an argument the judge turned down in May. Strauss-Kahn's lawyers had since asked McKeon to throw out part of her claim for other legal reasons. Court records show the judge had yet to rule on that and several other legal issues, and it appeared that a high-stakes step ? depositions, or pretrial questioning under oath ? had not yet been taken. Depositions can give both sides information and a better picture of how strong the key parties and other witnesses might be in court.

While the vast majority of civil cases end in settlements, some legal observers were surprised that the deal between Strauss-Kahn and Diallo came before the legal arguments were resolved.

"I really expected it to go a little farther," said Matthew Galluzzo, a criminal defense lawyer and civil litigator who has been following the Strauss-Kahn case closely.

Still, the case likely had taken a toll on both Diallo, a single mother of a teenage daughter, and Strauss-Kahn, who has found himself plagued by accusations of sexual misconduct that further sullied his reputation. The Socialist had been seen as a potential leading candidate for the French presidency before his New York arrest.

In France, judges are to decide by Dec. 19 whether to annul charges linking him to a suspected prostitution ring run out of a luxury hotel in Lille. He acknowledges attending "libertine" gatherings but denies knowing that some women present were paid.

In August, a separate case against Strauss-Kahn, centered on allegations of rape in a Washington, D.C., hotel, was dropped after French prosecutors said the accuser, an escort, changed her account to say she wasn't raped.

Soon after Strauss-Kahn's arrest in New York last year, French writer Tristane Banon accused him of attempting to rape her during an interview in 2003, a claim he called imaginary and slanderous. Prosecutors said they believed the encounter qualified as a sexual assault, but the legal timeframe to pursue her complaint had elapsed.

The Associated Press does not name people who report being sexually assaulted unless they come forward publicly, as Diallo and Banon have done.

Strauss-Kahn has separated from his wife, journalist and heiress Anne Sinclair, who stood by him through the allegations in New York. The two said they were filing a lawsuit this summer against a French magazine, citing invasion of privacy, for reporting they had split, but Sinclair later acknowledged it was true.

The New York Times first reported the agreement between Strauss-Kahn and Diallo.

In a legislative battle that has stretched on for nearly 15 years, the Philippines legislature has once again failed to move on a reproductive health bill that would ensure universal access to contraceptives and sexuality education in schools. Public support for the bill is solid, with nearly 70 percent of the predominantly Catholic population in favor of the measure. But that hasn't stopped the Catholic Bishops' Conference of the Philippines (CBCP) from throwing its full weight against it, even going so far as to threaten lawmakers who support the bill with a Church-sponsored opposition campaign against them in their 2013 elections.

Given the bill's measures to increase access to modern contraception, this harsh backlash from the country's Catholic hierarchy comes as no surprise. What does make this particular battle interesting is the messaging employed by one Catholic Bishop in his attempt to sway public opinion -- and how completely disconnected it is from the realities the people of the Philippines face each day.

Like most of the developing world, the Philippines is an increasingly youthful country, with children and adolescents making up about 35 percent of the total population. Perhaps that is why in his public admonition of the reproductive health bill Archbishop Socrates Villegas chose specifically to appeal to the "beloved youth" of the Philippines.

He begins by comparing the current heated political debates over the reproductive health bill to quarreling between parents, but assures them that the Church's stance against contraception and the battle it is currently waging in the Philippines are done out of love for and in defense of young people's souls. "Contraception is corruption," he states, a phrase he goes on to repeat three times.

What is so corrupting about contraception? According to the Bishop, using contraceptives teaches us "babies are nuisances" and "children are annoying" instead of gifts. It also leads to cancer, abortion, a country's total economic demise and killing our grandparents. (Just look at Europe, he says.) Poverty, he argues, is not caused by high fertility, but by corruption, specifically corrupt government officials. He challenges the argument that slowed population growth will lessen the strain on the country's resources, education system and healthcare not by proposing a logical counterargument, but instead by endearing young people, referring to them as "God's gift to us." He closes with this warning, "Fight contraception or we perish as a godly nation. This battle is for you and I fight for love of you."

Bishop Villegas claims that his fight against contraception is one out of love for young people. He is fearful for their future, he says. But how can one claim to be acting out of love for young people without thoroughly addressing the concerns and bleak circumstances of their futures?

The Philippines is a nation steeped in poverty. Nearly half of Filipinos live on less than $2 a day -- and that population continues to grow. While the overall fertility rate has fallen in recent decades, the Philippines continues to have one of the highest rates amongst its Asian neighbors, resulting in an annul population growth of 1.8 percent. The disparities in fertility rates among Filipino women are directly related to poverty and lack of education. Women from the wealthiest, most educated sector of the country on average have two children while those in the poorest, least educated have five or more. Larger families are typically poorer than smaller families and have fewer resources to invest in their children's education. An uneducated girl is more likely to give birth to more children, and thus the cycle continues.

The main cause of this disparity in fertility is lack of access to contraception for the country's poorest women. Only a third of all married women of childbearing age use modern contraceptives. More than a fifth of married women say that they want to delay or prevent pregnancy but aren't currently using a reliable family planning method. Among the country's poorest women, 41 percent say that they want to prevent pregnancy but aren't using any form of birth control. This unmet need for family planning leads to high rates of unintended pregnancies, which are not only economically burdensome but increasingly dangerous and even life-threatening. Maternal mortality rates actually rose by 36 percent between 2009 and 2011, and without increased access to health services like family planning, more and more Filipino women will lose their lives giving birth.

There are many reasons a woman might not use contraceptives despite wanting to avoid a pregnancy. She might not have medically accurate information about various methods or access to a clinic that provides family planning. She might experience familial pressure to have more children. Addressing these and other barriers will require a concerted effort from the government, medical professionals, NGOs and civil society, but passage of this reproductive health bill is a critical first step in addressing one of the fundamental barriers for many Filipinos: cost. If all women, regardless of economic status, are empowered to make decisions about if, when and how many children they have, the positive ripple effects will be experienced by generation after generation.

If the Catholic Church prevails in its fight against this bill, we can expect poverty to increase, more deaths from maternal complications, and more children dying before their fifth birthday. Bishop Villegas and his counterparts are not acting out of love for young people. They are, in fact, acting immorally by insisting that young people leave their reproductive destinies -- and their children's futures -- to chance.

Costco Joins Parade of Special Dividends ahead of Tax Hike

Retailer Costco Wholesale Corp. said it would pay a special dividend totaling roughly $3 billion, the largest payout so far from any company ahead of a likely increase in the U.S. dividend tax.

The warehouse club operator will use proceeds from a $3.5 billion debt offering to pay for the dividend, it said Wednesday. It also posted higher-than-expected November sales, and its shares rose 6.3 percent.

Several companies have declared one-time cash payouts in recent days ahead of a likely increase in the dividend tax rate due to the so-called fiscal cliff ? a combination of tax increases and spending cuts due to kick in at the beginning of 2013 if Congress and the White House cannot agree on a plan to reduce the federal budget deficit.

In some cases, insiders are among the biggest beneficiaries of the special payouts, as well as shifts of regular dividends into 2012 from 2013.

That is not the case at Costco, known for keeping prices low while compensating employees with wages and benefits above the U.S. retail average.

Co-founder Jim Sinegal, who left his position as chief executive officer on his 76th birthday in January, is the chain's 33rd-largest shareholder. However, he is also the company's biggest individual owner, with about 2 million shares, according to Thomson Reuters data.

By contrast, Las Vegas Sands Corp. Chairman Sheldon Adelson, a billionaire Republican donor, and his family stand to get more than half of the casino developer's special dividend announced on Monday. The payout totals about $2.27 billion, based on the number of outstanding shares as of Sept. 30.

Also on Monday, Dillard's Inc. announced a special dividend of $5 per share. Dillard family members are three of the top 11 shareholders at the department store operator. On Tuesday, spirits company Brown-Forman Corp. declared a $4-a-share special dividend. Two of the nine largest Brown-Forman shareholders are affiliates of the Brown family.

On Wednesday Guess Inc. declared a special $1.20-a-share dividend. Members of the Marciano family control more than 26 percent of Guess stock.

In early November, Wynn Resorts Ltd. paid a dividend of $8 per share, including a regular 50-cent payout. Chief Executive Officer Stephen Wynn and his ex-wife, Elaine, each own nearly 10 percent of the company's stock.

On Nov. 19, Costco's biggest rival, Wal-Mart Stores Inc., moved its planned dividend to late December from early January to help shareholders avoid any increase in the tax rate. The family of founder Sam Walton owns just over half of the company's shares.

One governance expert said it always raises suspicions whenever a company dominated by insiders decides to pay out a large dividend, since they reap the rewards.

"We would automatically raise a red flag for a company if it was paying out an unusually large cash dividend at this point in the year simply to take account of potential tax hikes without taking into account long-term investment," Paul Hodgson, chief research analyst at governance group GMI Ratings.

But Hodgson said dividends like Costco's could potentially be seen as something like corporate altruism, if insiders were not benefiting and a dividend was the best use of cash.

Costco's dividend is worth nearly $3.07 billion, based on the number of shares outstanding as of early September, the end of the company's fourth quarter.

Costco shareholders have done well since the worst of the financial crisis. The shares have had a total return of 56.9 percent since end of September 2008, compared with a 32.8 percent total return for Standard & Poor's 500 index.

Special dividends "make a lot of sense right now" given the looming tax increase, and other companies may follow suit, said Randy Warren, chief investment officer of Warren Financial Service, a registered investment advisory firm.

"We might even see something from some tech companies, some of the giants that have a lot of cash on their balance sheets, companies like Apple, Microsoft and Cisco," he said. "The timing is the overwhelming consideration, but if they really had something better to do with the cash I'm sure they would do it."

Warren's holdings include Costco, Apple Inc., Microsoft Corp. and Cisco Systems Inc.

LOTS OF CASH

The third item on Costco's code of ethics is to "take care of our employees." Fifth on the five-point list, the company's "ultimate goal" is to "reward our shareholders."

Costco keeps expenses low, everywhere from its Issaquah, Washington, headquarters to stores, where shoppers who pay annual membership fees of up to $110 carry purchases out in their own bags or reused cardboard boxes.

The hot-dog-and-fountain-drink combo sold at Costco's food courts is a longstanding signal of the chain's focus on low prices. The combo has cost $1.50 since Costco started selling hot dogs from a cart in 1985.

Costco will pay its special dividend on Dec. 18 to shareholders of record on Dec. 10.

November sales at Costco stores open at least a year rose 6 percent, topping the analysts' forecast of 5.4 percent growth, according to Thomson Reuters I/B/E/S.

LUBBOCK, Texas (AP) ? Stanley Marsh 3, the eccentric millionaire artist best known for his ?Cadillac Ranch? art display along an interstate in the Texas Panhandle, was charged Wednesday with 11 felony counts of molesting children.

The 74-year-old turned himself in at a county jail after an arrest warrant was issued, accusing him of molesting two teenagers in 2010. His arrest follows the filing of several lawsuits against him for allegedly paying 10 teens for sex acts.

The charges could go before a grand jury in the next few weeks or soon after the first of the year, special prosecutor Matt Powell said.

?This is the beginning of the process,? Powell said. ?This is what we felt like we needed to do.?

According to criminal complaints filed in Potter County, Marsh had the teens engage in sexual acts, including masturbation and oral sex, on three days in 2010. He was charged with six counts of child sexual assault and five counts of sexual performance by a child.

Marsh?s criminal attorneys, Paul Nugent and Heather Peterson of Houston, denied the charges, saying in a statement that the teens in the civil cases waited until Marsh suffered a massive stroke last year to move forward with a plan ?to become multimillionaires? by signing with a Houston personal injury attorney.

?The investigation into the group?s claims is far from complete,? the attorneys wrote in their statement. ?There should be no premature rush to judgment. Stanley Marsh 3 is not guilty of the group?s allegations, and will fight as vigorously as his declining health permits.?

The six lawsuits claim Marsh paid the boys, ages 15 and 16, for sexual acts. One claimed that Marsh provided him drugs and alcohol, bought him two cars, and paid him at several points during a year in sums of as much as $10,000.

Marsh?s civil attorney, Kelly Utsinger, has denied those allegations. He did not immediately return a call seeking comment on Wednesday?s criminal complaints.

The teens? Houston-based civil attorney, Anthony Buzbee, said two of the teens went to police in late summer before the lawsuits were filed, but two others didn?t speak with investigators until early November ? about the time Marsh?s offices were searched. One teen?s mother sought out a civil attorney when she didn?t hear back from police, according to the lawsuits.

Marsh is probably best known for planting 10 brightly painted Cadillacs nose down along Interstate 40 in the Panhandle in the 1970s. The cars, ranging from a 1948 club coupe to a 1963 sedan and gathered from junkyards, private collectors and used car lots, have since become a pop art landmark.

Visitors through the years have splattered them with graffiti and in 2005 they were coated in pink to honor breast cancer victims, survivors and their families. Marsh also has painted them black and yellow to honor the passing of longtime friends.

An Amarillo native and philanthropist, Marsh and his wife have donated to local art and education causes. After he suffered the massive stroke and a series of smaller ones, his wife was appointed his guardian.

Marsh was indicted on charges of indecency with a child in 1996, but the charges were eventually dismissed. That same year Marsh acknowledged no wrongdoing in a settlement with a youth who claimed Marsh sexually abused him.

In 2001, parties in four lawsuits that alleged imprisonment, sexual misconduct and harassment of teens were settled. Marsh apologized but no other details were made public.

Barber reported OK after "minor" cancer surgery

Congressman Ron Barber?s office says the Arizona Democrat is doing well after undergoing what it calls ?minor surgery? to remove a cancerous tumor from his tongue.

The office says Barber had the surgery Monday and was released from a hospital Tuesday.

A statement quotes Dr. Audrey Erman as saying the surgery was successful and that Barber is expected to make a full recovery.

The statement says Barber learned of the tumor on Nov. 13, a week after he won a full two-year term from Arizona?s 2nd Congressional District.

Barber?s office says he?s feeling good and staying in Tucson this week but looking forward to returning to work in Washington next week.

Barber was a former aide to Gabrielle Giffords. Both were wounded in a January 2011 mass shooting in Tucson.

Even in the cold darkness of winter, a hot muggy mosquito infested day sounds miserable. Thankfully, there?s now an air conditioner that doubles as a mosquito repellent. The repellent comes in the form of ultrasonic waves, which make a sound that drives away the pesky insects.

The high-tech gizmo from LG Electronics sounds like a must-get for the wealthy Florida retiree on your holiday shopping list, but it?s intended as a potential game-changer for parts of Africa where malaria, a mosquito-transmitted disease, is a major public health threat.

In tests, the unit deterred 64 percent of malaria-transmitting mosquitoes within 24 hours and 82 percent overall.

The company even took Africa?s notoriously unreliable power supplies into consideration as it designed the Anti-Mosquito air conditioner. It is outfitted with technology meant to withstand the electric current fluctuations associated with repeated blackouts and extreme operating conditions.

Yes, air conditioners are a relative luxury, but with research on anti-malaria vaccines stumbling and low-cost mosquito nets becoming less effective, an air conditioning unit that shoos away a good portion of the deadly mosquitoes today is that much cooler.

Detroit company gets auto show and movie cars ready for prime-time

I know you, dear readers, love the glitz and glamour of the North American International Auto Show. We are the Motor City after all. But did you ever wonder who builds some of those great Ford concept vehicles, prototypes and cutouts you ooo and ahh over??It?s Detroit talent.

Did you ever wonder who teamed up with Dreamworks and GM to build the cool vehicles used in the Transformer 2 movie? It?s Detroit talent.

Did you ever wonder who works with the agencies and preps vehicles for some of those cool Ford car ads? It?s Detroit talent.

Did you ever wonder who salvages and disposes of Ford test vehicles? It?s Detroit talent.

Did you ever wonder who gets some of those muscle cars, street rods, custom, collector and special interest vehicles in tip-top shape for the Woodward Dream Cruise?

Again, it?s Detroit talent.

Restoration Modification Mustang New BodyDST Industries, which sits within earshot of the runways at the Detroit airport in Romulus, is responsible. ?It?s a full-service, Tier 1 automotive supplier that offers an entire portfolio of services for large automakers, individual auto enthusiasts, the photo and film production industries and more.

Ford is its core customer. DST makes, delivers, preps, stores and recycles many of those Ford auto show concepts and prototypes ? not just for the Detroit show but also for others such as the LA Auto Show, which is going on this week. DST will prep, deliver and maintain 60 Ford vehicles for that show and then turn around and get ready for the Detroit show in January. That means working 24/7 ? no long holiday breaks for them ? and they love it ? stress and all.

?This is a reactionary business,? says Don Snell, COO of DST Industries. ?We must adjust our time.?

When the Los Angeles and Detroit auto shows are behind them the DST team will get those vehicles ready and deliver them to shows in New York and Washington, DC, as well as regional auto shows in places like Grand Rapids, Grand Haven, Cleveland and Toledo.

The work is challenging and the DST team must spin in a dime when its customers demand changes or have new ideas. Do you remember working the interactive Ford Touch at the auto show? Well, it was built at DST. ?Do you remember Mustang Garage? Also DST.

Many auto show concepts and prototypes as well as test vehicles have a short life span. DST?s vehicle recovery services remove and recycle usable parts from one-off prototypes to high-mileage fleet vehicles and then dispose of the vehicles. Untested and concept parts are scrapped. Reusable parts are sold at auction or used right away. The vehicles are then crushed, melted down and what?s left is recycled. ?The process has saved Ford $3 ? $4 million annually and is environmentally friendly, Snell says.

DST?s work doesn?t stop with auto shows and scrappage. ?It also plays a key role in advertising campaigns ? work that is fun, challenging and sometimes very scary.

A few years back DST worked on an ad for the Ford F350 where the truck had to pull a boat through the ice. The ad was shot in Russia. To get the truck where the ad was filmed the team had to rent a Russian fishing trawler. It required moving the vehicle from Norway to Russia as well as filming on the black sand beaches in Iceland. ?This was the most complicated ad the DST team has worked on ? at least so far, says Snell. Adding polar bears to the mix sure didn?t help.
DST also offers marketing support. Its operation in Palm Springs houses film and video production facilities that include sound and photo stages, private outdoor grounds with a mountain backdrop and other services. That operation also serves as the launch point for getting vehicles ready for the LA Auto Show.

Getting cars ready for the movies, too

That said, fun is essential to the DST team and Snell says working on the Transformer 2 vehicles for Dreamworks and GM was great fun. The team build 20 vehicles that turned into Jolt (Chevy Volt), Bumblebee (Chevy Camaro), Mudflap (Chevy Trax), Slidz (Chevy Beat), Sideswipe (Chevy Stingray), Ratchet (Hummer H2), Swerve (Chevy Aveo) ? well you get the idea. Many of these vehicles were just in the concept stage so DST hand built fiberglass bodies that had to withstand trips to filming locations such as the George Washington Bridge, an Air Force base in California and sites in Israel.

The team had three months to deliver the finished vehicles.

?The GM guys didn?t think we could get it done in time,? says Snell. ?They were amazed. We have very talented people working for us. We put 50-60 people on it and they worked 24/7.
?The Michigan film credits gave us the opportunity,?? he says. ?We bid on Transformers 3 but it was a no go because the lack of film credits.??

DST employs 165 people, some of whom have been with the company for more than 40 years.

Restoring cars in Detroit

So what do they do in the offseason? Auto shows are basically early winter, spring and late fall events. A year ago DST added an auto restoration business in Romulus, which keep the summer months full.

It?s a lucrative business. Many baby boomers are still in love with the cars they owned or wanted as teenagers and will often spend more than the vehicle is worth. ?It?s an emotional thing,?? says Bob Milligan, who heads the classic/vehicle restoration business. DST?s most expensive work ? a $90,000 bottom-up restoration.

Detroit Unspun checked out some of the vehicles currently in the shop. We saw a redone Autorama-quality ?53 Chevy. There was a ?65 Mustang red convertible a guy from Florida wanted completely redone for the Woodward Dream Cruise. A ?75 Chevy Caprice with new engine paint and top. A ?57 Dodge Panel with a redone engine. We could go on and on.

Restoration isn?t a quick job. It takes an average of five months to get one done, says Milligan.

Still, DST was able to give Kurt Newman?s 1988 Mustang a facelift just in time for the Woodward Avenue Dream Cruise, according to a story on WXYZ. ?The car was disassembled the car, given a fresh coat of paint and new carpeting. Newman picked it up on Friday just in time for the Cruise.

DST was founded in 1955 and is a woman-owned business. President and CEO Brenda Lewo took over the business when her husband died several years ago and is working to grow the business. Fortunately, that seems to be happening.

Wall Street isn't backing Jack Lew for Treasury - Fortune Finance ...

FORTUNE -- Jack Lew, the frontrunner to be named Treasury Secretary in Obama's second term, isn't Wall Street's first choice for the key economic post. He's not even its second.

"I've talked to a bunch of investors and it's seen as a net negative going from [Tim] Geithner to Lew," says Chris Krueger, senior political analyst at Guggenheim Partners. "Who does Wall Street want? Not Jack Lew."

Lew,?57, spent three years on Wall Street working at Citigroup (C) as the chief operating officer of its alternative asset investment management unit. One of the funds Lew's group invested in was run by John Paulson, who at the time was betting heavily against the housing markets and banks. But that's not the part of Lew's resume that anyone seems to remember. And it's certainly not the important part.

After Lew, a Queens, New York native, graduated from Harvard University and Georgetown Law, he headed straight to Washington and has mostly stuck inside the Beltway ever since. He's been on teams credited with brokering major budget deals. He worked for Tip O'Neill when the House speaker struck a deal to raise taxes and cut benefits with President Reagan. And Lew was a key member of President Clinton's budget team, which simultaneously erased the deficit and struck a long-term deal with Republicans to preserve entitlements.

Under Obama, Lew served as the head of the Office of Budget and Management, and a year ago he became Obama's chief of staff.

Since the election Obama has seemingly been trying to patch things up with Wall Street, which threw its collective support behind Romney. After the election, Obama called JPMorgan Chase (JPM) CEO Jamie Dimon and other business leaders. And Lew recently met with Dimon to talk about the fiscal cliff. Geithner is expected to exit the Treasury job early next year.

Nonetheless, some financial executives say that if Obama were to choose Lew for Treasury Secretary, it would signal that the president is not as serious about mending his relationship with corporate leaders as he says. Wall Streeters say the two other candidates who are considered in the mix for the job, former investment banker and two-time second Erskine Bowles and BlackRock (BLK) CEO Larry Fink, would be preferable to Lew. Bowles has been a deficit hawk, and Fink clearly knows the debt market. What's more, unlike Lew, neither one would need an introduction to Wall Street.

Don Marron, a dean of Wall Street who was also once rumored to be a top pick for the Treasury Secretary job (under a Bob Dole presidency in 1996), says he doesn't know Lew, or where he stands on business issues. And Marron?says that will be a problem for corporate America and the market. "Lew will be more of an unknown at a time when you don't want unknown," he says.

Strangely enough, Democrats don't seem so excited about Lew either. They don't think he will be tough enough on Wall Street. And by picking Lew, who has little background in regulating financial markets, Obama would signal that he is more focused right now on striking a budget deal, and less focused on further tinkering with the rules on Wall Street.

Lew wouldn't be the first Treasury Secretary to come from more of a political background instead of Wall Street or corporate America. James Baker, for instance, served as the Treasury Secretary during Reagan's second term.?But the relationship between the Treasury Secretary and Wall Street matters more than it used to. One of the legacies of Tim Geithner, who is a lifetime regulator, has been to focus the position more on market regulation. The Treasury Secretary is now the head of the Financial Stability Oversight Council, the newly formed team of regulators that is supposed to be on the lookout for risks that could cause future crises. And the relationship between the economy and the market's performance is much closer than it was back in Baker's day.

So some of this can be dismissed as more Masters of the Universe griping they are not being heard by Obama. But not all of it.

NIH 'Director's New Innovator Award' to Dr. Debra Auguste supports investigation of personalized drug delivery vehicles

For some time, researchers have known about disparities in diagnoses and outcomes among breast cancer patients based on race and age. However, they have been challenged to develop a set of criteria that can be used to reliably target drug delivery mechanisms based on an individual patient's tumor.

Dr. Debra Auguste, associate professor of biomedical engineering in the Grove School of Engineering at The City College of New York, will investigate personalized therapies to inhibit breast cancer metastasis supported by the National Institutes of Health Director's New Innovator Award. The grant, which provides $1.5 million over five years, funds "exceptionally creative new investigators who propose highly innovative projects that have the potential for unusually high impact."

"By applying our knowledge and experience in chemical engineering, materials science and nanotechnology, we hope to develop therapeutics that will increase breast cancer patient survival by inhibiting tumor progression and metastasis," said Professor Auguste, who joined the Grove School faculty in September from the Harvard University School of Engineering and Applied Science.

"Our goal is to use biological information to design new drug delivery vehicles that can target tumors. We have been studying what the cell surface looks like, how proteins relate to one another, how they are organized and what their ratios are."

The strategy marks a departure from other investigations that have focused on the role of messenger RNA, which is transcribed into proteins. "People often think if you have a large amount of messenger RNA you have a large amount of protein, but we don't necessarily know how much protein is being produced," she said.

Current breast cancer treatments are regulated by cell surface presentation. For example, breast cancer cells that express estrogen receptor and human epidermal growth receptor-2 on their surface are treated with hormone (anti-estrogen or aromatase inhibitors) or targeted therapies such as the monoclonal antibody trastuzamab (Herceptin), respectively.

Professor Auguste plans to develop personalized treatment approaches for four metastatic breast cancer populations: black women, white women, women over 40 and women under 40. Epidemiological studies have found that white women are more likely than black women to be diagnosed with breast cancer, however black women are more likely to die from it. In addition, women under 40 are more prone to aggressive forms of the disease.

She expects to characterize the surface density and proximity of two receptors that govern cell recruitment: CXC chemokine receptor type 4 (CXCR4) and CC chemokine receptor type 7 (CCR7). This information will then be used to synthesize complementary engineered liposomes (CELs) that cooperatively bind CXCR4 and CCR7 and deliver short interfering RNA (siRNA) to knock down lipocalin-2 (Lcn2), which has been shown to induce the epithelial to mesenchymal transition (EMT).

Lipocalins are a family of proteins that transport small, hydrophobic molecules such as steroids, retinoids and lipids. A growing body of evidence points to the EMT playing a role in metastasis of cancers.

Professor Auguste hopes to produce CEL therapies that will enhance cooperative binding to each cell type and reduce cell migration and invasion. Homogeneous and biphasic CELs are designed to complement the relative surface density and organization of receptors on breast cancer cells. They do so by allowing conjugated antibodies to rearrange on the surface or by clustering antibodies within gel-phase lipid domains.

"The binding event is regulated by multiple receptors. We need to understand how multiple proteins work together to engineer adhesion," she explained. "If we can understand that, we can hopefully go from a non-adhesive vehicle to one that is adhesive in order to trigger a favorable response. The key is adhesion of the drug delivery vehicle to tumor cells."

In previous research targeting cytokine-activated endothelial cells, Professor Auguste reported evidence that vehicles that complement the cell surface enhance binding.

Professor Auguste plans to encapsulate cancer drugs inside a lipid shell that will be very similar to a cell membrane and decorate the shell with one or more antibodies arranged in different ratios. She also intends to "play around" with the molecules' surface mobility and organization. "We'll test lots of different engineering parameters in order to achieve optimal efficacy."

To assess the effect of CEL on cell migration, activation survival and the EMT process, she will conduct mechanistic studies involving the expression of various proteins and enzymes.

Professor Auguste intends to demonstrate similarities and differences among six different breast cancer cell lines and deliver a platform technology designed to address tumor metastasis. The cell lines chosen represent the most metastatic and invasive forms of breast cancer with the poorest prognoses for survival. "We want to learn what is different about these breast cancers and whether we can develop a better treatment that can more effectively target the tumor and control it," she said.

It differs from traditional NIH grants in that it is designed specifically to support unusually creative new investigators with highly innovative research ideas at an early stage of their career when they may lack the preliminary data required for an R01 grant. Israeli forces kill Gaza man despite cease-fire

Updated at 7:55 a.m. ET: GAZA -- A 20-year-old Palestinian was killed and 10 others injured by Israeli forces Friday, Palestinian medical officials told NBC News, despite the U.S.-brokered cease-fire declared Wednesday.

The men were shot on the Gaza side of the border as they tried to access their farmland in the eastern part of Khan Younis, the Palestinian Medical Service said early Friday.

Palestinian Foreign Minister Riad Malki said the shooting had broken the cease-fire, Reuters reported.?Malki, speaking at a meeting with Italian Foreign Minister Giulio Terzi, called the incident ?a clear violation of the agreement and should not be repeated.?

Israel's military said it had accomplished its objectives while Hamas claimed victory after the two sides exchanged deadly airstrikes and rocket attacks for over a week.

The Israeli Defense Forces imposes a no-go zone on the Gaza side of the border, but the officials said the men believed they would be able to access their farmland safely during the truce, which began late Wednesday.

A spokesman for the IDF told NBC News that it did not have any immediately information about the death of Palestinian.

The spokesman said there were several "incidents of disquiet and unrest at the Gaza border" and that "Israeli soldiers fired warning shots in the air.?

When the rioters did not comply, the soldiers responded by firing at the rioters legs, the spokesman added.

The cease-fire between Israel and Hamas had been holding firm, with scenes of joy among the ruins in Gaza on Thursday, including a celebratory rally past wrecked houses and government buildings.

However, schools stayed closed in southern Israel, where nerves were jangled by warning sirens - a false alarm, the IDF said.

Residents of Gaza return to their homes with hope the cease-fire persists. ITV's John Ray reports.

The truce was the fruit of intensive diplomacy by Egypt?s new Islamist regime, spurred by U.S. President Barack Obama, who sent Secretary of State Hillary Clinton to the Middle East.
