California agriculture employee settled $350K sexual harassment suit

Sexual harassment that occurs at a workplace is illegal. The employer may be liable for the sexual harassment that occurs at their business, even though the employer may not have directly committed the sexual harassment. A California employer was recently held liable for their actions in relation to sexual harassment that occurred between its employees.

California has a large amount of agriculture and large businesses that run the agriculture industry. The large employer in this sexual harassment lawsuit was a large grape growing business. The agriculture business employs many agriculture workers. This lawsuit began when a 17 year old female employee was sexually harassed by another worker. The young girl and four co-workers informed their management about the sexual harassment. After they reported the sexual harassment, the employer terminated all five employees. Following the termination, the former employees contacted the U.S. Equal Employment Opportunity Commission to report the incident. The company was sued for sexual harassment and retaliation.

The lawsuit against the California employer recently settled the federal lawsuit. Pursuant to the settlement, the employer will pay $350,000 in damages and implement companywide procedures to deter future sexual harassment. The employer is required to provide its employees with sexual harassment and retaliation training, overhaul the employer's anti-discrimination policies and procedures and implement a human resource program to effectively handle future complaints. Sexual harassment complaints are taken very seriously and have potentially severe ramifications.
